Reporting from the U.S.-Mexico border ahead of Title 42 ending Thursday night, Owen Shroyer filmed evidence of illegal immigrant pipelines at border wall gates.

Owen also stumbled across a historic marker commemorating the Treaty of 1848 that ended the Mexican-American war and established a territorial border.

He asked if Mexico or the U.S. broke the treaty as we’re currently witnessing millions of illegal immigrants flooding America.

WASHINGTON, May 5 (Reuters) – The United States is getting ready to lift COVID-19 restrictions that have blocked migrants caught at the U.S.-Mexico border from seeking asylum since 2020, a major policy shift with humanitarian and political implications.

    WHAT IS TITLE 42?

The COVID restrictions, known as Title 42, were first implemented under Republican then-President Donald Trump in March 2020 at the beginning of the pandemic. At the time, the U.S. Centers for Disease Control and Prevention (CDC) said the order was needed to stem the spread of the coronavirus in crowded detention settings.

Title 42 allowed border agents to rapidly expel many migrants to Mexico, but some public health experts, Democrats and advocates criticized its health justification, saying it was part of Trump’s goal of curbing legal and illegal immigration.

President Joe Biden, a Democrat, took office in 2021 vowing to reverse Trump’s restrictive approach, but kept Title 42 in place and expanded it as his administration grappled with record migrant arrests at the U.S.-Mexico border.

Since its inception, migrants have been expelled more than 2.7 million times under Title 42, although the total includes many repeat crossers and Mexico has generally only accepted certain nationalities.

    WHAT IS HAPPENING THIS MONTH?

The Biden administration intends to lift Title 42 next Thursday when the U.S. COVID public health emergency ends.

Migrants caught crossing the border will again be able to request asylum, a process that can take years to resolve.

U.S. border officials are preparing for a possible increase in illegal crossings, the result of pent-up demand and the perception among migrants that they will be allowed in.

The numbers are already climbing. In April, the U.S. Border Patrol apprehended some 183,000 migrants, according to preliminary data provided by Brandon Judd, president of the National Border Patrol Council, a 13 percent increase from March.

More than 19,000 migrants are currently being held in U.S. Customs and Border Protection facilities, exceeding capacity by 200 percent, according to Judd.

WHAT IS THE PLAN ONCE TITLE 42 IS GONE?

To deter would-be migrants after the order is lifted, the Biden administration plans to issue a new regulation. It would deny asylum to most migrants caught crossing if they passed through another country en route to the U.S. without seeking protection or failed to use other legal pathways, which Biden has expanded.

U.S. authorities aim to process migrants in days and swiftly deport them if they fail an initial asylum screening.

Nearly 500 U.S. Citizenship and Immigration Services (USCIS) personnel will temporarily be assigned to help with the interviews and the Pentagon will send 1,500 troops to support the Border Patrol on a temporary basis.

The new Biden regulation toughening access to asylum is expected to face legal challenges. The administration may also struggle to hold migrants at the border and quickly deport them without additional funds from Congress.

COULD U.S. COURTS OR CONGRESS KEEP TITLE 42 IN PLACE?

The CDC tried in April 2022 to end Title 42, saying it was no longer needed to limit the spread of COVID-19 in light of vaccines and other medical advances.

But a federal judge in Louisiana blocked the termination after a challenge brought by two dozen U.S. states with Republican attorneys general, who argued increased migration would saddle their states with costs.

The U.S. Supreme Court removed a different Title 42 case from their argument calendar in February after the administration told them the order would end along with the COVID emergency. It is unknown whether legal battles could resume after May 11.

Separately, a bipartisan group of U.S. senators are trying to pass a bill that would grant immigration authorities the power to expel migrants back to Mexico for another two years, though its prospects for passage are unclear.

    HOW ARE U.S. CITIES RESPONDING?

U.S. border cities are bracing for a possible rise in migrants when Title 42 ends.

Migrant apprehensions in Texas’ Rio Grande Valley have increased in recent weeks as more Venezuelans are crossing illegally there, according to the U.S. Border Patrol, and the spike in arrivals is straining shelters.

The Texas cities of Brownsville, El Paso and Laredo have issued emergency declarations.

Texas Governor Greg Abbott this week resumed a campaign to bus migrants to Democratic-led cities. The Republican governor blames Biden for the rise in crossings and seeks to lessen the burden on border cities.

New York City Mayor Eric Adams, a Democrat whose city has received thousands of migrants on buses from Texas, has called on the federal government to provide more funding for cities welcoming migrants and to expedite migrant work permits.

April 28, 2023 at 05:24PM    US Lawmaker: 700,000 to 1 Million Illegals Gather at US Border with Mexico to Storm Country After Title 42 Ends (VIDEO) | The Gateway Pundit

On Friday’s War Room Steve Bannon reported on the 700,000 to one million illegals gathering at the US border with Mexico and ready to storm into the United States.

Steve Bannon: We had a Congressman, Andy Biggs, who sat here and said he just got off a conference call with certain executives in Big Counties on the border in Arizona, and they were telling him they had just had a briefing by Border Patrol who said along the Southern border of the United States, there’s 700,000 to a million illegal aliens prepared, when Title 42 comes off, they’re basically prepared, he said, to storm the gates. And the Border Patrol is not prepared for it. The Biden regime is not prepared for this. This Title 42 that comes off is going to be something. And of course, the mainstream media will not cover this.

Ben Berqguam: I’m over here in Matamoros, Steve. I’m right on the Mexico side of the border. Anthony is on the other side in Brownsville. We were reporting from there yesterday. I’m actually in that camp we were in about a month ago and it has grown probably doubled or tripled what it was then. It had over 1000 then. It has more than that now. And what’s happening is, as they come in, they’re just going across. We have 2000 people a day crossing here… It’s just an absolute joke. And this is before Title 42 goes away. They are lining up, they are mobilizing, and it’s going to be a mass invasion when that goes away.

The Biden regime is going to destroy this country beyond repair. The gates are open. And the media will not report on this.

  • Biden Admin Pressured El Paso To Not Declare Emergency Over Migrant Surge

Biden Admin Pressured El Paso To Not Declare Emergency Over Migrant Surge

Democrat Joe Biden is responsible for the Border Invasion we are seeing, and according to numerous reporters, Biden has tied the hands of law enforcement to do anything to help protect the American people, and now we have proof that he is pressuring officials to not fix up the mess he made.

Now there are media reports confirming what Biden has been up to:

The New York Post reported that the White House tried to convince the Democratic mayor of El Paso, Texas, not to declare an emergency declaration over the influx of illegal immigrants entering the city because it would reflect badly on President Joe Biden. At least three El Paso city council members urged Leeser to declare the emergency, but the White House urged against making that call during a phone call.“He told me the White House asked him not to,” Councilmember Claudia Rodriguez said, according to the New York Post. The city is seeing an average of 900 illegal migrants per day and estimated costs up to millions to sustain its support efforts.

  • Massive Migrant Caravan Heading For U.S. Border – Potentially Largest Ever

Massive Migrant Caravan Heading For U.S. Border – Potentially Largest Ever

June 6, 2022 at 04:31PM Massive Migrant Caravan Heading For U.S. Border: ‘Potentially Largest Ever’

Another massive migrant caravan described as “potentially the largest” ever is currently en route to the U.S. border, with some participants pointing to President Joe Biden’s statements among their reasons for coming.

One Haitian traveling with the caravan told Fox News he wants Biden to keep his promise to allow them to stay once they arrive.

“He promised the Haitian community he will help them,” the migrant said on Friday. “He will recall Title 42. He will help us have real asylum.”

    The outlet continued:

The migrant is taking part in a caravan that could become the largest ever to reach the U.S. southern border, with the current number of close to 10,000 migrants, is expected to swell to about 15,000 before it reaches the border.

The caravan departed Tapachula on the Mexico-Guatemala border on Monday. The migrants, which mostly come from Venezuela, Cuba and Nicaragua, will travel what is known as the coastal route to reach the U.S. border.

Fox News labeled the masses of migrants “potentially the largest caravan ever.”

“We consider we are around 9,500, it measures 5 1/2 km from the start to the end, people keep on joining, in the first police check there were approx 100-150 national guard, INM, state police and let us through freely,” the caravan’s organizer, Luis Villagran, told Fox News on Monday.

Their comments come as the Biden administration continues to wage legal war in its bid to end Title 42, a Trump-era rule that authorized rapid deportation of most illegal aliens, bypassing the typical legal process, due to the pandemic.

The intent of the rule was to slow the spread of the deadly virus, though President Trump was labeled a racist for implementing it. Earlier this year, the Centers for Disease Control and Prevention announced it planned to lift the order.

“But a lawsuit filed by 24 states at least temporarily put plans to end the rule to a halt, with a Louisiana U.S. District Judge ruling that the restrictions can stay in place until the lawsuit is resolved,” Fox News noted. “The states have argued that lifting the rule would lead to a ‘wave of illegal migration and drug trafficking.’”

Critics have pointed fingers at President Biden for creating what has turned into a migrant crisis after reversing the vast majority of immigration and border security policies Trump implemented — which led to historic reductions in illegal crossings. Trump also managed to finance the construction of hundreds of miles of border wall, which some Border Patrol agents have said was helpful in curbing illegal crossings.

The results of his policy reversals are historic levels of illegal immigration and drug smuggling, which have been detrimental to his approval rating and may have led to a change of heart.

“Don’t leave your town or city or community,” Biden said in an interview with ABC last year. “We’re gonna make sure we have facilities in those cities and towns run by department of — by DHS and also access with HHS, the Health and Human Services, to say you can apply for asylum from where you are right now.”

But that said, Biden’s actions are speaking louder than his words. He has yet to re-impose Trump-era rules and his administration is continuing to argue against border security measures Trump enacted that Biden cannot quickly end.

That sends the message to migrants that it is still okay to try and make it to the U.S.

“Now we need him to keep his promise.” the Haitian migrant said.

Republican governors have attempted to give Biden a taste of his medicine.

Earlier this spring, Govs. Greg Abbott of Texas and Doug Ducey of Arizona began busing illegal migrants to Washington, D.C., as a means of keeping them out of their states and forcing the administration to have to deal with them directly.

“According to TDEM, Abbott’s plan is already working. The agency told Fox News on Monday that many of the communities that originally reached out for support – from the Rio Grande Valley to Terrell County – say the federal government stopped dropping immigrants in their towns since Abbott’s announcement on April 6,” the network reported separately in mid-April.

  • Federal judge stops Biden from ending Title 42 border policy

Federal judge stops Biden from ending Title 42 border policy

Cincinnati, Ohio (TB100) May 21, 2022 at 05:36AM Federal judge stops Biden from ending Title 42 border policy

A federal judge dealt a blow to the Biden administration Friday by halting its planned cessation Monday of a pandemic health policy allowing authorities to turn away unauthorized migrants at the southern border.

U.S. District Court Judge Robert Summerhays of the Western District of Louisiana on Friday afternoon blocked the U.S. government from ending the Title 42 policy, forcing U.S. border officials to continue turning most illegal migrants back to Mexico rather than taking them into custody.

The injunction was a response to a suit filed by the states of Arizona, Louisiana, and Missouri, claiming the government had failed to plan for handling the anticipated surge in noncitizens expected to cross when Title 42, promulgated by the Centers for Disease Control and Prevention, goes away and that the influx of releases would harm states. A total of 24 states are listed as plaintiffs.

Summerhays wrote in his decision that the states “established a substantial likelihood of success based on the CDC’s failure to comply with the rulemaking requirements” under federal law, justifying keeping the policy in place as the case works through the courts.

At the onset of the pandemic, the CDC recommended that U.S. border authorities expel people rather than take them into custody on the basis that it would slow the spread of the coronavirus. Since then, the United States has expelled 1.7 million people through the authority, including some multiple times. Those expelled did not face legal charges despite unlawful entry being a misdemeanor the first time and a felony thereafter.

The Trump administration enforced Title 42 to a greater extent than the Biden administration has. Under former President Donald Trump, virtually all illegal immigrants were expelled to Mexico or their home country.

But expulsions became more complicated in late 2020, when people from countries beyond Mexico and Central America began crossing the border at higher rates than had been seen in the Border Patrol’s 98-year history. Because the Mexican government refused to accept back migrants from countries beyond Central America, the U.S. was forced to take them into custody.

Because families cannot go through immigration removal proceedings in the 20 days in which they are legally permitted to be detained, they are released and told to show up for court years down the road. The immigration courts have approximately 1.5 million cases pending before roughly 500 judges nationwide.

Migrant releases only add to the backlog of cases, and the increase in releases over the past two years has further burdened the courts. The number of migrants encountered attempting to enter the U.S. without legal permission has risen under Title 42, from 17,000 in April 2020 to 234,000 last month. Republicans have overwhelmingly pushed to maintain the policy, saying that allowing the Border Patrol to turn people away immediately is necessary to prevent a worse crisis.

Karine Jean-Pierre, the White House press secretary, released a statement Friday evening saying the Biden administration disagrees with the court’s ruling and the Department of Justice would appeal the decision.

“The authority to set public health policy nationally should rest with the [CDC], not with a single district court,” she said.

Behind closed doors, the Biden administration has been concerned that walking back Title 42 could prompt a “mass migration event.”

Between 5,000 and 7,000 noncitizens have been encountered attempting to cross the border illegally each day over the past year. The Department of Homeland Security was specifically concerned that Mexican cartels would take advantage of the forthcoming change in border policy and attempt to push as many people into the country as possible. DHS had been planning for a worst-case scenario of 18,000 people per day in the six weeks following May 23, far beyond the 1,000 that the Obama administration had said would constitute a crisis.

Once Title 42 ends, people who are apprehended illegally crossing the border or deemed inadmissible for entry at the ports will face one of three options.

The government could use a process known as “expedited removal” to repatriate that person to their home country, though it is contingent on that person not claiming a fear of being returned. However, it’s not clear if the Mexican government will accept non-Mexicans. If the person claims asylum during the expedited removal process, they would undergo an initial asylum screening called a “credible fear” interview and be referred to immigration court if they pass.

Others will be referred directly to immigration court, and likely released into the U.S., pending the resolution of their case. Some could be held in U.S. Immigration and Customs Enforcement detention facilities, though the pandemic and the Biden administration’s aversion to detaining people for civil offenses makes detention far less likely.

Finally, some migrants may be returned to Mexico under a policy implemented during the Trump administration, the Migrant Protection Protocols. Known informally as the “Remain in Mexico” policy, it forces asylum-seekers to go back to Mexico for weeks to months while they wait to appear in court rather than releasing them into the U.S. The Biden administration unsuccessfully tried to end the policy last year, but the Supreme Court ordered it be reinstated.
