BREAKING: EMERGENCY MOTION FILED WITH JUDGE JUAN MERCHAN TO STOP PROSECUTION OF PRESIDENT DONALD J. TRUMP

On Saturday April 1, 2023, Constitutional Advocate Peter T. Santilli announced to his audience on The Pete Santilli Show that he was taking a stand and intends to intervene as a voter for President Donald J. Trump.

On Sunday April 2, 2023 at approximately 9pm, Santilli filed his motion with Judge Juan Merchan who is presiding over the impending so-called ‘criminal case’ against President Trump.

In Santilli’s motion, he also requested that the judge formally address potential violations of federal law prohibiting depravation of Constitutional rights as set forth in 18 USC Code § 242 which states as follows:

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

In his Emergency Motion, Santilli asserts that all eligible citizens of the United States have a right to vote, and the only purpose of government is to protect our unalienable rights. In the Declaration of Independence, Thomas Jefferson was very clear when he wrote:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.–That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed

Essentially, the motion makes it very clear that our founding documents which include the Declaration of Independence and the U.S. Constitution unequivocally state the intentions of our founders when they created the laws of our nation. Santilli states, “The truths they set forth are self-evident, meaning no further debate or discussion is necessary. That all men are created equal…endowed by their creator with certain unalienable rights….and to secure our God given rights, government officials are elected, and given power by the people who voted for them.”

Santilli has also expressed that he believes the timing of the criminal indictment of President Donald J. Trump at time in which he is a declared candidate for President in November 2024 is directly violating his Constitutionally protected right to vote for the person he believes will protect his God given rights.

In the emergency motion Santilli asks the judge to “stay” or delay the proceedings until after the November 2024 election so as not to allow the case to interfere with his Constitutional right to vote, as well as interfere with his candidate of choice by influencing the public.

Considering the gravity of indicting the President of The United States, who just so happens to be a candidate for re-election in 2024, the potential violations of Santilli’s individual voting rights, as well as the potential for public unrest in protest, this motion must be taken very seriously. Through this motion, the court has been noticed that a voter has asserted his rights, and if anyone in government or under color of law causes violence, injury or even death, they could be prosecuted under 18 USC Code § 242.

The penalty for violating 18 USC Code § 242: “….shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.”

Santilli also states he is taking a stand to defend his right to vote — to give his consent to those who govern who he believes will protect his Constitutionally protected unalienable, or God given rights. “This is the hill I choose to die on, and in fact, many men and women have certainly sacrificed their lives for my inheritance. I will not back down from this. I will use every peaceful and lawful means available to me, but if anyone in our government thinks they can seize power without my consent and threaten to take away my God given rights, then we are no longer the United States of America i serve as a United States Marine.”

“Hopefully, my fellow Americans will stand with me in defense of my individual rights. If not, at the very least, please cheer me on because I will never let all of my fellow veterans who have died for our Country to have died in vein. Ever! This is the hill I have always chosen to die on when I swore an oath as a United States Marine…and the only people who would feel threatened by me being an American are those who intend to take away my God given rights, and they should feel threatened.” Santilli states.

“If you want my country. If you want my President, then you will have to get past me. I am prepared to die because there is no doubt that the people who have taken over our country want to kill me if I do not stand down. I will never stand down, and hopefully my fellow Americans are courageous enough to stand with me. “

“Some people have recently told me, ‘Santilli, you need to be careful with what you say, we need you to be able to come back and fight another day’. I now tell anyone who repeats that nonsense, that if we don’t take a stand now for what is right — and be fully prepared to die for what we believe in (because they want to kill us) — there will not be another day. I’m lighting the first candle in hopes that this entire regime collapses in the same fashion Communist Romania did.”
